Professional responsibility Adverse authority or adverse controlling authority , in United States law , is when an attorney finds a legal decision that has some controlling authority on the case they have before the court, which goes against the position they are arguing. The attorney is under an ethical obligation to disclose that legal decision, which is an adverse authority , to the court.
