  1. Shipping markets

ref improve date June 2010 orphan date December 2009 The international shipping industry can be divided into four closely related shipping markets , each trading in a different commodity the freight market , the sale and purchase market, the newbuilding market and the ship breaking demolition market . These four markets are linked by cash flow and push the market traders in the direction they want. The freight market The freight market consists of ship owner shipowners , chartering shipping charterers and shipbroking brokers . They use four types of contractual arrangements the voyage charter , the contract of affreightment , the time charter and the bareboat charter . Shipowners contract to carry cargo for an agreed price per tonne while the charter market hires out ships for a certain period. A charter is legally agreed upon in a charter party in which the terms of the deal are clearly set out. The sale and purchase market In the sale and purchase market, used good second hand ships are traded between shipowners. The administrative procedures used are roughly the same as in the real estate business, using a standard contract . Trading ships is an important source of revenue for shipowners, as the prices are very volatile. The second hand value of ships depends on freight rates, age, inflation and expectations. The newbuilding market The newbuilding market deals with transactions between shipowners and shipbuilding shipbuilders . Contract negotiation can be very complex and extend beyond price. They also cover ship specifications, delivery date, stage payments and finance. The prices on the newbuilding market are very volatile and sometimes follow the prices on the sale and purchase market. The demolition market On the demolition market ships are sold for ship breaking scrap . The transactions happen between shipowners and demolition merchants, often with speculators acting as intermediaries. 1. Bareboat charter

Admiralty law A bareboat charter is an arrangement for the Chartering shipping chartering or hiring of a ship or boat , whereby no crew or provisions are included as part of the agreement instead, the people who Renting rent the vessel from the owner are responsible for taking care of such things. There are legal differences between a bareboat charter and other types of charter arrangement, commonly called time or voyage charters. In a voyage or time charter the charterer charters the ship or part of it for a particular voyage or for a set period of time. In these charters the charterer can direct where the ship will go but the owner of the ship retains possession of the ship through its employment of the master and crew. In a bare boat or demise charter, on the other hand, the owner gives possession of the ship to the charterer and the charterer hires its own master and crew. The bare boat charterer is sometimes called a disponent owner . The giving up of possession of the ship by the owner is the defining characteristic of a bare boat or demise charter. In shipping In a bareboat charter no administration or technical maintenance is included as part of the agreement. The charterer obtains possession and full control of the vessel along with the legal and financial responsibility for it. The charterer pays for all operating expenses, including fuel, crew, port expenses and P&I and Marine insurance hull insurance . A demise charter is a form of bareboat charter in which the charter period may last for many years and may end with the charterer acquiring title ownership of the ship. In this case, a demise charter is a form of hire purchase from the owners, who may well have been the shipbuilders. Demise chartering is common for tankers and bulk carriers. ref http www.maritimeknowhow.com English Know How Chartering types of contracts of affreightment bareboat charter.html Maritime knowhow bareboat charter ref In yachting In yachting a bareboat charter is usually for a s ...   more details

  1. Demurrage

for the carrying cost of currency Demurrage currency Update EB date January 2011 The term demurrage originated in Chartering shipping vessel chartering notably voyage chartering and refers to the period when the charterer remains in possession of the vessel after the period normally allowed to load and unload cargo laytime . By extension demurrage refers to the charges that the charterer pays to the shipowner for its extra use of the vessel. ref http www.maritimeknowhow.com English Know How Charter parties voyage charter party gencon clause 7 demurrage.html Maritime Knowhow website GENCON Clause 7 ref Officially, demurrage is a form of liquidated damages for breaching the laytime set out in the governing contract the charter party . The demurrage sometimes causes a loss to the seller as it increases cost of the total freight. ref http www.maritimeknowhow.com English Know How Charter parties voyage charter party gencon clause 7 demurrage.html Maritime Knowhow website GENCON Clause 7 ref The reverse of demurrage is despatch . If the charterer requires the use of the vessel for less time than the laytime allowed, the charter party may require the shipowner to pay despatch for the time saved. After the laytime has expired, and the vessel is on demurrage, no exceptions or interruptions to laytime are relevant, even during force majure events such as strikes, etc. This is based on the principle that if the charterer had completed loading or discharging within the agreed laytime, the vessel would have left the port before the force majure event could intervene hence the thumb rule once on demurrage, always on demurrage . The term demurrage has been extended to use in the hire or rental of assets other than ships. Shipping In commercial ship chartering , demurrage is an ancillary cost that represents liquidated damages for delays. It occurs when the vessel is prevented from loading or discharging cargo within the stipulated laytime see Affreightment under Charter parties . ...   more details
