refimprove date May 2011 The doctrine of the affections , also known as the doctrine of affects , doctrine of the passions , theory of the affects , or by the German term Affektenlehre after the German Affekt plural Affekte was a theory in musical aesthetics popular in the Baroque music Baroque era 1600 1750 . Citation needed date May 2011 Claim of popularity needs a citation. It derived from ancient theories of rhetoric and Public speaking oratory Buelow 2001 , and was widely accepted by late Baroque theorists and composers. Citation needed date May 2011 The essential idea is that just one unified and rationalized Affekt should be aimed at by any single piece or movement of music, and that to attempt more was to risk confusion and disorder. Citation needed date May 2011 According to one version of the theory there are three pairs of opposing emotions that make six affects all together love hate, joy sorrow, wonder desire. Citation needed date May 2011 Another authority also mentions sadness, anger, and jealousy Buelow 2001 . Lorenzo Giacomini 1552 1598 in his Orationi e discorsi 1597 defined an affection as a spiritual movement or operation of the mind in which it is attracted or repelled by an object it has come to know as a result of an imbalance in the animal spirits and vapours that flow continually throughout the body Giacomini 1597, Page needed date May 2011 . The doctrine fell out of use in the classical period music Classical era , when composers and theorists began to find it excessively mechanical and unnatural. Citation needed date May 2011 Affections are not the same as emotions however, they are a spiritual movement of the mind Palisca 1991, 3 . The Alienation Office 1576 1835 was a British Government body charged with regulating the alienation or transfer of feudal lands without a licence from the Government. The first regulatory structure for dealing with alienation of lands was created during the reign of Henry III of England Henry III . The king issued an ordnance prohibiting the tenants in chief of feudal lands from alienating those lands without a proper licence from the state. The penalty for not going through the licencing system was forfeiture of the lands concerned. The next major change occurred in 1327, when the penalty for not following the licensing system was changed from forfeiture to a fine. The fine was payable to the Hanaper of the Lord Chancellor Chancery . As with many British legal and regulatory systems a gradual evolution took place to an accepted system. The penalty for alienating land without a licence became one year s revenue from that land, and the payment required for an alienation licence was one third of the value of the land to be alienated. In 1576, the Alienation Office itself was first properly established. Robert Dudley, 1st Earl of Leicester was granted a 10 year lease which covered the revenues due under the alienation of property licensing regime. The lease also covered the monies payable from pre fines that became payable during the actual process within the jurisdiction of the Court of Final Pleas . This rule is an exception to the general rule in property law that favors free alienability. The exception is recognized to benefit minors, incompetents, and trust beneficiaries that may otherwise behave as a spendthrift would. A spendthrift trust is an example of an arrangement containing an anti alienation provision. The governing document of such a trust provides that the trust corpus may not be reached by creditors while the property is held in the trust. Creditors aware of this legal restriction on alienation may choose not to lend to the spendthrift. Tort law Dignitary torts are a specific category of intentional tort s where the cause of action is being subjected to certain kinds of indignities. ref John C. Goldberg, Anthony J. Sebok, Benjamin C. Zipursky, Tort Law Responsibilities and Redress 2004 . ref Historically, this category of torts was often covered by the old England English writ of trespass vi et armis . Historically, the primary dignitary torts were Battery tort battery , Assault tort assault , and false imprisonment , as each claimed harm to a person s human dignity . A cause of action could be brought for battery, for example, even if no injury was done to the plaintiff, so long as the contact would be offensive to a reasonable person. Under modern jurisprudence the category of dignitary torts is more closely associated with secondary dignitary torts, most notably defamation slander and libel , false light , intentional infliction of emotional distress , invasion of privacy , and alienation of affections . In some jurisdictions, the phrase is limited to those torts which do not require physical injury or threat of physical injury, limiting the class to only those secondary incidents. The only non intentional act classified as a dignitary tort is negligent infliction of emotional distress , although this is also sometimes classified as simply another form of negligence .
