Vander Westhuizen v Arnold ref 2002 6 SA 453 SCA . ref is an important case in South African contract law , heard in the Supreme Court of Appeal of South Africa Supreme Court of Appeal on February 22 , 2002, with judgment handed down on August 29 . Facts The respondent, Johan Heinrich Arnold, had signed an agreement of sale for a motor vehicle which provided that no warranty whatsoever has been or is given to me by the seller or his agent s . The agreement had been drawn up by the appellant, Gideon Andries vander Westhuizen, the seller. Arnold had been aware when he purchased the vehicle that it was in need of repair. The discussions between Arnold and Vander Westhuizen, prior to the conclusion of the contract, had related to the condition of the vehicle. Subsequent to Arnold s taking possession of the vehicle, a bank claimed ownership of it. To avoid the bank s claim, Arnold paid the bank the amount outstanding to it. He then claimed that amount from Vander Westhuizen, basing his claim on the implied warranty against eviction . Vander Westhuizen raised the exclusion clause in defence of the claim. Judgment On appeal, the court held per Lewis AJA , that the surrounding circumstances what passed between the parties, their negotiations and their conduct did not show that the words no warranty whatsoever had included the implied warranty against eviction. Biography According to Houbraken he was a student of Philips Wouwerman and Adriaen van de Velde . His birthdate is uncertain, but he was judged to be about forty when he died of tuberculosis. Houbraken thought he caught the disease from melancholy resulting from losing a large sum of money said to be 4,000 Dutch florins, a very large sum for a painter to have , which depressed him. He always suspected his landlord, who rented him the room he had been staying in when it happened. It is unclear how he came into the possession of such a large sum of money, whether by selling paintings or by inheritance. ref Language icon nl Middle Dutch http www.dbnl.org tekst houb005groo01 01 houb005groo01 01 0406.htm Johannes vander Bent biography in De groote schouburgh der Nederlantsche konstschilders en schilderessen 1718 by Arnold Houbraken , courtesy of the Digital library for Dutch literature ref According to the Rijksbureau voor Kunsthistorische Documentatie RKD , some of his works have been incorrectly attributed to Nicolas Berchem . ref http www.rkd.nl rkddb dispatcher.aspx?action search&database ChoiceArtists&search priref 6635 entry for Johannes vander Bent in the RKD ref Commons category References reflist Persondata Metadata see Wikipedia Persondata .
