Daniel William Dan Willie Morrison May 28, 1881 &ndash August 10, 1951 was a miner and political figure in Nova Scotia , Canada. He represented Cape Breton County in the Nova Scotia House of Assembly from 1920 to 1925 as an Labour candidates and parties in Canada Independent Labour member. He was born in Marion Bridge, Cape Breton Island , the son of Angus A. Morrison and Flora McDonald. In 1919, he married Julia McLeod. Morrison served in a battery unit during World War I . He was mayor of Glace Bay, Nova Scotia Glace Bay from 1921 to 1933 and from 1934 to 1950. He was defeated when he ran for reelection in 1925 and was an unsuccessful candidate for a seat in the House of Commons in 1926. Morrison represented Canadian Labour at the League of Nations from 1930 to 1937. He was district president for the United Mine Workers of America from 1928 to 1942 and auditor for that organization from 1942 to 1951. Morrison served on the Dominion Coal Board from 1947 to 1951. He died in Glace Bay at the age of 70. More specifically, W.D. examines sexual assault cases and burdens of proof in evidence law. Background D. W., a 42 year old man, was charged with sexually assaulting a 16 year old girl, T. W., on two occasions while driving her to her boyfriend s house. T.W. was staying at D.W. house at the time. Besides her claim of the event, there was little circumstantial evidence. Her panties had semen stains from a Type A secretor, which included D. W., but also 30 population. The secretor type of the boyfriend was never known. At trial before a judge and jury the defence argued that she was not credible. She was unemployed, illiterate, and a dropout, and had been kicked out of several houses including D. W. s house. The testimony of D.W. was poor, but its uncertain whether it was due to lack of intelligence or deception. At the end of the trial the judge issued its charge to the jury without mention of any issue of credibility. Less than ten minutes later the Crown made a request for a recharge to bring this issue up. Counsel for the Crown requested the recharge in order for the judge to explain what evidence may assist the jury in making a finding on the issue of credibility. During the recharge, the judge charged to the jury that If in fact you believe the accused then clearly nothing took place and in fact the Crown will have failed to prove beyond a reasonable doubt that he is guilty as charged. He carried his party s banner as an unsuccessful candidate for the U.S. Senate in 1962 and for the governorship in 1982. Workman was born in Greenwood, South Carolina Greenwood to Mr. and Mrs. W.D. Baillie and often referred to as Captain Baillie owing to his military background.
