It held that a variation of company workplace customs, which are incorporated into individual contracts of employment can take place after a proper consultation without breaching employees contracts. Facts Ms Dryden was a nursing auxiliary in a Glasgow hospital . She smoked. After consultations, which she did not contribute to, smoking was banned. She claimed constructive dismissal on the basis that the workplace custom being unilaterally changed breached her employment contract. Judgment Lord Coulsfield held that a unilateral variation on the workplace rules did not amount to a breach of any contract term. Infobox Court Case name Rainey v Greater Glasgow Health Board court House of Lords image caption date decided full name citations 1987 IRLR 26 judges prior actions subsequent actions opinions transcripts keywords Discrimination Rainey v Greater Glasgow Health Board 1987 IRLR 26 is a UK labour law case concerning the justifications for unequal pay. Facts Ms Rainey was a prosthetist. Men had been recruited from private practice, to the Board s new prosthetic fitting service, which had previously been done by private contractors. The men had comparable qualifications and experience. They were paid 40 more. The women were directly recruited on the NHS pay scale. There had been no arrangements to phase out the pay disparities. Judgment Lord Keith, overturning Lord Denning in Clay Cross said that material meant significant and relevant and one should consider all the case s circumstances, which may well go beyond personal qualities. Cquote In particular, where there is no question of intentional sex discrimination whether direct or indirect and there is none here a difference which is connected with economic factors affecting the efficient carrying on of the employer s business or other activity may well be relevant Citing Bilka Kaufhaus ... If the national court finds that the measures chosen by Bilka correspond to a real need on the part of the undertaking, are appropriate with a view to achieving the objectives pursued and are necessary to that end, the fact that the measures affect a far greater number of women than men is not sufficient to show that they constitute an infringement of Article 119 . It was not a question of the appellant being paid less than the norm but of her comparator being paid more. He was paid more because of the necessity to attract him and other privately employed prosthetists into forming the nucleus of the new service. Further, there would not appear to be any material distinction in principle between the need to demonstrate objectively justified ...   more details

  1. Smith v. Board of School Commissioners of Mobile County

Unreferenced stub auto yes date December 2009 Smith v. Board of School Commissioners of Mobile County , Case citation 827 F.2d 684 11th Cir. 1987 , was a lawsuit in which the United States Court of Appeals for the Eleventh Circuit held that the Mobile, Alabama schools could use textbook s which purportedly promoted secular humanism , characterized by the complainants as a religion . Parents and other citizens brought a lawsuit against the school board, alleging that the school system was teaching the tenets of an anti religious religion called secular humanism. The complainants asked that forty four different elementary through high school level textbooks be removed from the curriculum. After an initial ruling in a federal district court in favor of the plaintiffs, the U.S. Court of Appeals for the Eleventh Circuit ruled that as long as the school was motivated by a secular purpose, it didn t matter whether the curriculum and texts shared ideas held by one or more religious groups. The Court found that the texts in question promoted important secular values tolerance, self respect, logical decision making and thus the use of the textbooks neither unconstitutionally advanced a nontheistic religion nor inhibited theistic religions.
