Heywood 1994 3 S.C.R. 761 is a leading Supreme Court of Canada decision on the concept of fundamental justice in Section Seven of the Canadian Charter of Rights and Freedoms section seven of the Charter. The Court found that section 179 1 b of the Criminal Code of Canada Criminal Code for vagrancy was overbroad and thus violated section 7 and could not be saved under section 1. Background In 1987, Heywood was convicted under section 246.1 1 now s. 271 1 of the Criminal Code for sexual assault of children. The conviction made him subject to section 179 1 b which prevented certain convicted individuals from loitering. In July 1989, Heywood was arrested in Beacon Hill Park in Victoria, British Columbia Victoria for loitering at or near a playground under section 179 1 . He had been spotted several times previously near the playground carrying a camera with a telephoto lens. Upon arrest the police got a search warrant and found collections of pictures of children at play. At trial, Heywood argued that the law violated section 7, 11 d , 12, and 15 of the Charter. The court found a violation of 7 and 11 d which was justified under section 1. Heywood was convicted. On appeal, the court affirmed the violations of section 7 and 11 d but also found that they could not be saved under section 1, and so the conviction was overturned. Reasons of the court In a 5 to 4 decision, the Court dismissed the appeal, finding a section 7 violation ... 34 DEFAULTSORT R. V. Philosophy Heywood saw what he believed to be a disproportionate concentration of capital in the hands of a few as the result of a selective extension of government backed privileges to certain individuals and organizations. He believed that there should be no profit in rent of buildings. He did not oppose rent, but believed that if the building was fully paid for that it was improper to charge more than what is necessary for transfer costs, insurance, and repair of deterioration that occurs during the occupation by the tenant. He even asserted that it may be incumbent on the owner of the building to pay rent to the tenant if the tenant keeps his residency in such a condition that saved it from deterioration if it were otherwise unoccupied. Tone date December 2007 The Heywood Manuscript is a collection of handwritten copies of letters and poems of the Heywood family, and letters from their relatives and friends, which was completed in 1798, and to which some explanatory passages have been added. Most of the letters and poems are by Nessy and Peter Heywood , and it may be that the transcription and reproduction of their correspondence and poetry was instigated by Peter as a lasting monument to his sister Nessy, who died so young, and who had devoted herself with indefatigatible energy to him and his release when he was imprisoned on HMS Hector and awaiting his court martial in connection with the Mutiny on the Bounty . There are five known versions of the manuscript, which were produced for members of the Heywood family. Two are privately owned, the other three are in libraries Manx National Heritage Library , Heywood Manuscript Acc No. 9519 1 1 186 Newberry Library , Chicago, Nessy Heywood, Correspondence 1790 92 Case MS E 5 .H 5078 State Library of New South Wales , Mary Heywood, Letterbook Microfilm CY 2809 .
