  1. Diplom-Jurist

Diplom Jurist is a master s level law degree awarded by some German universities. Background Historically, German law students did not receive any academic degree upon completion of their curriculum. Instead, after usually four or five years of study, students would sit their First State Examination Erstes Staatsexamen in Law, which was administered by the ministry of justice of the respective state, not the university. More recently, however, some universities have begun to award their students a Diplom Jurist upon passing the First State Examination, in order to indicate the equivalence of the education to a master s degree in other disciplines. Role for the legal profession The Diplom Jurist does not give the holder the right to work as, for instance, a fully qualified attorney Rechtsanwalt or a judge. The German legal education system requires examinees of the First State Examination to pass a two year practical training period Referendariat , at the end of which candidates sit the Second State Examination which, if passed, admits successful participants to the bar. As such, the Diplom Jurist is usually just a step towards qualifying as a lawyer, but not a qualification in its own right. However, holders of the Diplom Jurist degree may, of course, work as lawyers in unregulated legal professions where admittance to the bar is not required e.g. in house counsel . Other universities have begun to award Magister Juris degrees following the same principles. Category Education in Germany de Diplom Jurist lt Diplomuotas teisininkas ...   more details

  1. Callistratus (jurist)

Orphan date February 2009 Callistratus , a Roman law Roman jurist , who, as appears from passages in Pandects Justinian s Digest , wrote at least as late as the reign AD 198 211 of Septimius Severus and Caracalla . Associations In a passage of the Augustan History Alex. Sev. 68 which, either from interpolation or from the inaccuracy of the author, abounds with anachronisms, Callistratus is stated to have been a disciple of Aemilius Papinianus Papinian , and to have been one of the council of Alexander Severus . This statement may be correct, notwithstanding the suspicious character of the source whence it is derived. Works The numerous extracts from Callistratus in the Digest occupy eighteen pages in Karl Ferdinand Hommel Hommel s Palingenesia Pandectarum and the fact that he is cited by no other jurist in the Digest may be accounted for by observing that this work contains extracts from few jurists of importance subsequent to Callistratus. The extracts from Callistratus are taken from works bearing the following titles Libri VI de Cognitionibus Libri VI Edicti Monitorii Libri IV de Jure Fisci , or de Jure Fisci et Populi Libri III Institutionum Libri II Quaestionum The titles of the first three of these works require some explanation. de Cognitionibus This treatise relates to those causes which were heard, investigated, and decided by the emperor, the governor of a province, or other magistrate, without the intervention of judices . This departure from the ordinary course of the civil law took place, even before Diocletian s general abolition of the ordo judiciorum , sometimes by virtue of the imperial prerogative, and in some cases was regularly practiced for the purpose of affording equitable relief where the strict civil law gave no remedy, instead of resorting to the more tortuous system of legal fictions and equitable actions. 1. Gaius (jurist)

File Estatua de Gayo Tribunal Supremo Madrid .jpg 150px right thumb Gaius or Caius Roman jurist dablink This article is about the jurist. For the emperor Gaius Caesar, see Caligula . Gaius floruit AD 130 180 was a celebrated Roman empire Roman jurist . Scholars know very little of his personal life. It is impossible to discover even his full name, Gaius or Caius being merely his personal name Roman naming conventions praenomen . As with his name it is difficult to ascertain the span of his life, but it is safe to assume he lived from AD 110 to at least AD 179, since he wrote on legislation passed within that time. From internal evidence in his works it may be gathered that he flourished in the reigns of the emperors Hadrian , Antoninus Pius , Marcus Aurelius and Commodus . His works were thus composed between the years 130 and 180 . After his death, however, his writings were recognized as of great authority, and the emperor Theodosius II named him in the Law of Citations , along with Papinian , Ulpian , Herennius Modestinus Modestinus and Julius Paulus Paulus , as one of the five jurists whose opinions were to be followed by judicial officers in deciding cases. The works of these jurists accordingly became most important sources of Roman law . Besides the Institutes , which are a complete exposition of the elements of Roman law, Gaius was the author of a treatise on the Edicts of the Magistrates , of Commentaries on the Twelve Tables , and on the important Lex Papia Poppaea , and several other works.
