SCOTUS 1882 1887 Majority Miller JoinMajority unanimous court LawsApplied Ker v. Illinois , Case citation 119 U.S. 436 1886 , is a U.S. Supreme Court case. It held that a fugitive kidnapped from abroad could not claim any violation of the Constitution, laws or treaties of the United States. The incident that led to this decision involved with a Pinkerton Detective Agency agent, Henry Julian, was hired by the federal government to collect a larcenist, Frederick Ker, who had fled to Peru . Although Julian had the necessary extradition papers&mdash the two governments had negotiated an extradition treaty a decade earlier&mdash he found that there was no official to meet his request due to the recent Chilean military occupation of Lima. Rather than return home empty handed, Julian kidnapped the fugitive, with assistance from Chilean forces, and placed him on a U.S. vessel heading back to the United States. Her sister, Pauline, was born in 1906. After leaving the Chelsea School of Art , a meeting with society photographer Olivia Wyndham inspired Ker Seymer to teach herself photography. Her work eschewed artifice, instead aiming at producing naturalistic images, with her sitters relaxed rather than posed, as though they were just sitting around . These subjects included Nancy Cunard , Raymond Mortimer , Frederick Ashton , Edward Burra , Gertrude Stein and Julia Strachey . She opened her London studio above Asprey the jewellers in 1931, and at around the same time produced for Harper s Bazaar the photographic series Footprints in the Sand about up and coming writers one of her sitters was Evelyn Waugh . She was a friend of the Surrealist artist John Banting , managing to keep his suicidal moods at bay with her upbeat personality. With the onset of the Second World War and the dispersal of the avant garde scene in which she had operated, along with changes in public attitudes and shortages of photographic supplies, Ker Seymer abandoned her photography for work in a film studio, and spent the majority of the war living in the remote English countryside. She never returned to photography, instead opening one of London s first launderettes. She enjoyed the work, and the business became successful, which allowed her to bring up her son in security. The Ker Frisbie doctrine is applied in the context of extradition and generally holds that criminal defendants may be prosecuted in United States courts regardless of whether their presence has been obtained through the use of applicable extradition treaties. History In Ker v. Illinois , ussc 119 436 1886 , a messenger forcibly kidnapped the defendant from Peru and brought him back to the United States, even though he had been sent to Peru with a valid Warrant law warrant and instructions to obtain the defendant with the cooperation of the local authorities. Addressing Ker s due process challenge, the Supreme Court of the United States held that such forcible abduction is no sufficient reason why the party should not answer when brought within the jurisdiction of the court which has the right to try him for such an offence, and presents no valid objection to his trial in such court. Frisbie v. Collins , ussc 342 519 1952 , presented a case in which the defendant was tried in Michigan after being abducted by Michigan authorities in Chicago . Applying its decision in Ker , the Supreme Court upheld the conviction over challenges based on due process and federal kidnapping laws. More recently, the Supreme Court relied on the Ker Frisbie doctrine in United States v. Alvarez Machain , ussc 504 655 1992 . lvarez Macha n, a Mexico Mexican citizen who was abducted and brought to the United States at the direction of the Drug Enforcement Administration . The Court rejected the argument that such abductions undermine the usefulness of extradition treaties, and it refused to read general principles of international law weighing against such abductions into the Mexican extradition treaty.
