A mute of malice is a defendant in a criminal case who willfully chooses not to speak, as opposed to one who does not speak because he is physically or psychologically unable to do so see aphonia and muteness , respectively . In British jurisprudence, a separate trial is held before the main trial to determine whether the defendant is mute of malice or mute due to visitation of God. In the past, if he was found by the jury to be mute of malice, he d be tortured until either he spoke or died. In the Netherlands , the concept is not used as in most other countries, the defendant has a constitutional right to silence and a right to refuse self incrimination under all circumstances, such as in a court hearing or during a police questioning. The concept is practically foreign to American jurisprudence it does not even appear in Black s Law Dictionary because willfully choosing not to speak is a Constitutional right the defense attorney utters the plea and the defendant does not have to testify per the case Griffin v. According to the Gospel of Mark , when Jesus entered the region of the Decapolis after passing through Sidon and down the Sea of Galilee , some people brought to him a man who was deaf and could hardly talk, and they begged Jesus to place his hand on him. The Gospel of Mark then states blockquote 33 After he took him aside, away from the crowd, Jesus put his fingers into the man s ears. Then he spit and touched the man s tongue. 34 He looked up to heaven and with a deep sigh said to him, Ephphatha which means Be opened . 35 At this, the man s ears were opened, his tongue was loosened and he began to speak plainly. Jesus commanded them not to tell anyone. But the more he did so, the more they kept talking about it. People were overwhelmed with amazement. He has done everything well, they said. He even makes the deaf hear and the mute speak. blockquote Commentator of Mark , Lamar Williamson, writes that this is the last unit in a series of miracles concerned with the identity of Jesus, as earlier confirmed by Apostle Peter s christological affirmation in Mark 8 29 where Peter exclaimed You are the Messiah . ref Lamar Williamson 1983 Mark ISBN 0804231214 pages 138 140 ref See also Ministry of Jesus New Testament places associated with Jesus Parables of Jesus Muteness References Reflist Miracles of Jesus Category Christian miracle narrative Category Miracles attributed to Jesus Category Deafness Category Communication disorders Category Supernatural healing pt Jesus curando o surdo mudo da Dec polis ro Vindecarea su ... more details
