  1. Landmark National Bank v. Kesler

refimprove date December 2011 Tone date June 2010 On August 28, 2009, the Kansas Supreme Court issued a ruling regarding the standing, rights and interests of Mortgage Electronic Registration Systems MERS in Landmark Nat l Bank v. Kesler, 2009 Kan. LEXIS 834 Aug 28, 2009 . The court held that all indispensable parties must be identified and that the actual lender identified in foreclosure actions to protect each party s rights. The decision also addressed the role MERS plays in clouding the ownership of the promissory note and title to the property. In Landmark Nat l Bank v. Kesler, MERS, the appellant sought to invoke due process rights which it said were violated when MERS failed to get notice of the fact that their interest was being wiped out via a prior foreclosure it did not receive notice of. The Court said simply that MERS or any nominee didn t have any interest and proves its point by reference to simple statements in the documents and the simplest of laws and interpretation of the role of MERS and the requirements of recordation. The splitting or bifurcation of the promissory note or mortgage note and Mortgage law mortgage or deed of trust creates an immediate and fatal flaw in title. ref name kscourts http www.kscourts.org Cases and Opinions opinions supct 2009 20090828 98489.htm ref The Kansas Supreme Court went on to cite several other case across the nation and stated When the role of a servicing agent MERS acting on behalf of a mortgagee is thrown into the mix, it is no wonder that it is often difficult for unsophisticated borrowers to be certain of the identity of their lenders and mortgagees. In re Schwartz, 366 B.R. 265, 266 Bankr. D. Mass. 2007 and then cited the Supreme Court of New York Kings County that said T he practices of the various MERS members, including both the original lender and the mortgage purchaser , in obscuring from the public the actual ownership of a mortgage, thereby creating the opportunity for substantial abuses and prejudi ...   more details

Overview In modern usage, a landmark includes anything that is easily recognizable, such as a monument , building , or other structure . In American English it is the main term used to designate places that might be of interest to tourist s due to notable physical features or historical significance. Landmarks in the British English sense are often used for casual navigation , such as giving directions. This is done in American English as well. In urban studies as well as in geography , a landmark is furthermore defined as an external point of reference that helps orienting in a familiar or unfamiliar environment. ref Lynch, Kevin. The image of the city . MIT Press, 1960, p. 48 ref Landmarks are often used in verbal route instructions and as such an object of study by linguist s as well as in other fields of study. A variant is a seamark or daymark , a structure usually built intentionally to aid sailors navigating featureless coasts. An example is the tower at Walton on the Naze in England.
