He was born in Quebec City in 1806, the grandson of Thomas Aylwin . Aylwin studied at Harvard University , then articled in law and was called to the bar in 1827. He entered the practice of law in partnership with Edward Short Canadian judge Edward Short . In 1841, he was elected to the Legislative Assembly of the Province of Canada for Portneuf electoral district Portneuf he was reelected in 1844 and 1848 for Quebec City. Aylwin served as solicitor general for Canada East from 1842 to 1843, resigning to protest Governor Sir Charles Metcalfe, 1st Baron Metcalfe Charles Metcalfe s refusal to consult the Executive Council on patronage appointments, and served again in the same post in 1848. Later in 1848, he resigned his seat to accept an appointment as judge in the Court of Queen s Bench. Aylwin resigned from the bench in 1868 after suffering a stroke . He died in Montreal in 1871. John Cushing Aylwin June 14, 1778 &ndash January 28, 1813 was an officer in the United States Navy during the War of 1812 . Born in Quebec, Canada , Aylwin worked on board United Kingdom British naval vessels at an early age. Though never formally enrolled in the Royal Navy , he received increasing responsibilities eventually performing the duties of a mate by 1795. He refused the offer of a midshipman s warrant but continued service at sea apparently against his will for another six years. Ill health, however, finally brought about his return home. Then, for several years, he commanded merchant ships out of Boston, Massachusetts . When war between the United States and Great Britain broke out in 1812, Aylwin received an appointment as a lieutenant in the United States Navy and became sailing master in USS Constitution Constitution . He received commendations for his gallantry during that frigate s engagement with HMS Guerriere 1806 Guerriere on 19 August 1812. Lt. Aylwin took part in the battle between Constitution and HMS Java 1811 HMS Java on 29 December 1812. Severely wounded during that encounter, Aylwin later died at sea.
