Fergusonv. NTSB , 678 F. 2d 821 9th Cir. 1982 is a landmark aviation ruling by the United States Court of Appeals for the Ninth Circuit handed down on June 2, 1982. On July 31, 1979 Lowell G. Ferguson was the captain of Western Airlines Flight 44 from LAX Los Angeles , California to seven locations, including Las Vegas, Nevada , Denver, Colorado , and Sheridan, Wyoming . Ferguson, with over 12,000 hours of flying experience, had never been found in violation of any Federal Aviation Regulations. It was the first officer, James Bastiani, who flew the aircraft, while Ferguson handled radio communications. However, due to Aviation Regulation, Ferguson was considered the PIC Pilot in Command as Captain of the aircraft. At approximately 10 00 pm, the plane mistakenly landed at Buffalo, Wyoming thinking the airport to be their destination airport of Sheridan. While there was no emergency and no injuries, some damage was done to the airport tarmac that was not constructed to hold the weight for a commercial airliner. The aircraft was a Boeing 737 . The daughter of a local actor named Plessy, she was a pupil of Samson at the Conservatoire in 1829. Plessy made her debut as Emma at the Com die Fran aise in 1834 in Alexandre Duval s La Fille d honneur . She had an immense success, and Mademoiselle Mars Mlle Mars , to whom the public already compared her, took her up. Until 1845 she had prominent parts in all the plays, new and old, at the Th tre Fran ais , when suddenly at the height of her success, she left Paris and went to London to marry the dramatic author, J. F. Arnould d. 1854 , a man much older than herself. The Com die Fran aise, after having tried in vain to bring her back, brought a suit against her and obtained damages. In the meantime, Madame Arnould Plessy accepted an engagement at the French theatre at St. Petersburg Mikhaylovsky Theatre , where she played for nine years and was greatly appreciated by Nicholas I and the Russian aristocracy. In 1855 she returned to Paris and was re admitted to the Com die Fran aise, as pensionnaire in an engagement for eight years. This second part of her career was even more brilliant than the first. She revived some of her old roles, but her later triumphs were especially associated with new plays by Emile Augier , including Ma tre Gu rin . Ivan Graeme Ferguson , Order of Canada CM born 7 October 1929 in Toronto , Ontario , Canada is a Canada Canadian filmmaker and inventor who co invented IMAX . Ferguson was appointed a Member of the Order of Canada in 1993. He Graduated from the University of Toronto with a Bachelor of Arts degree. Notable History Graeme Ferguson was one of three co founders of IMAX Corporation and thereby one of the creators of the IMAX . A film maker from his childhood in the 1930 s, he was still making films in 2010, with a executive producer credit on Hubble 3D . Ferguson is also notable because of his involvement a landmark 1983 lawsuit brought by his ex wife, who had been part of the founding team of IMAX. The claim involved a series of oppressive acts by Ferguson and his colleagues including a resolution to discharge her from the company and being pressured to sell back her shares. Brooke JA writing for the Court of Appeal found that the acts were tantamount to oppression and the resolution was barred.
