    A Provisional Constitutional Order , or PCO , is an extra constitution al order that suspends either wholly or partially the Constitution of Pakistan . It provides a temporary constitution while the actual constitution is held in abeyance or suspension. Provisional Constitutional Order of 1981 The first Provisional Constitutional Order in the history of Pakistan was declared by General Zia ul Haq on March 24, 1981. Higher judiciary was asked to take oath of office under the PCO. In the Supreme Court of Pakistan , only Justice Dorab Patel and Justice Fakhruddin G. Ebrahim declined. They were asked to tender their resignation, which they did. Provisional Constitutional Order of 1999 main 1999 Pakistani coup d tat The second PCO in the history of Pakistan was declared by General Pervez Musharraf on October 14, 1999, immediately after a coup d etat . The PCO was also accompanied by a declaration of a state of emergency .   1. Provisional order

    Provisional Order is a method of procedure followed by several government departments in England, authorizing action on the part of local authorities under various acts of Parliament of the United Kingdom Parliament . Procedure by provisional order is a substitute for the more expensive course of Local and Personal Acts of Parliament in the United Kingdom private bill legislation it is usually employed for such purposes as alteration of areas, compulsory purchase of land and building of light railways. A preliminary local inquiry is first held in public by an inspector of the department to whom application has been made to issue it. Upon the report of the inspector and other information, the department decides whether or not to issue the order. The order when issued has no force until it is confirmed by parliament. For this purpose it is included with other orders in a confirming bill, introduced by the minister at the head of the department concerned. In both houses of parliament all provisional order bills are referred to examiners for compliance with standing orders. In the House of Lords , if a provisional order bill is opposed, it is referred to a select committee and then to a committee of the whole house if not opposed, it goes, after second reading, to a committee of the whole house, and in both cases then proceeds as a public bill. In the British House of Commons House of Commons , the bill goes after second reading to the committee of selection or to the general committee on railway and canal bills if unopposed it is treated as an unopposed private bill if opposed it goes to a private bill committee, which hears evidence for and against.     Expert subject Law date February 2009 Judicial remedies The purpose of a provisional remedy is the preservation of the status quo until final disposition of a matter can occur. Under United States law , Federal Rules of Civil Procedure FRCP 64 provides with several types of seizure e.g. garnishment , replevin , Attachment law attachment that a Federal Court may use pursuant to state law. FRCP 65 concerns Temporary Restraining Order may be made ex parte and preliminary injunction requires some hearing . In order to establish the constitutionality of a provisional remedy, two cases must be distinguished. The 3 part test established in Matthews determines whether a prejudgment remedy meets the constitutional requirements when Government seeks deprivation on its own initiative. The court must take into consideration the private interest of the party against whom the remedy is sought, the risk of erroneous deprivation as well as the probable value, if any, of addition or substitute safeguards and, the moving party s interest. The 3 part test established in Connecticut v. Doehr determines whether a prejudgment remedy meets the constitutional requirements when Government action is applied to a suit between private parties. The due process analysis involves the same requirements as set forth in Matthews. The court must also take into account whether there are exigent circumstances, a bond requirement, a judicial assessment, a detailed statement of factual basis, and a prompt post seizure hearing. Mail with the Vineta provisional stamp was sent from Pernambuco to Germany on April 17, 1901. Only 600 stamps were issued making the provisional one of the rarer stamps in German philately . Controversy The stamp gained notoriety because it had been catalogued by the Michel catalogue as a regular stamp and given the number 67. Collectors who aspired to put together a complete collection of issues of the Reichspost had an interest in acquiring this stamp.
