The PublicHealthAct 1875 was established in the United Kingdom to combat filthy urban living conditions, which caused various publichealth threats, including the spread of many diseases such as cholera and typhus . Reformers wanted to resolve sanitary problems, because sewage was flowing down the street daily, including the presence of sewage in living quarters. The act required all new residential construction to include running water and an internal drainage system. This act also led to the government prohibiting the construction of shoddy housing by building contractors. Many factors delayed reform, however, such as the fact that to perform a clean up, the government would need money, and this would have to come from factory owners, who were not keen to pay, and this further delayed reform. But reformers eventually helped to counteract the government s laissez faire attitude, and a publichealthact was introduced in 1875. Purpose of Act The Act has two main purposes The first is to add a new criterion to the statutory tests applied by a sheriff or the Scottish Ministers when considering whether to order the discharge of a restricted patient. The sheriff and the Scottish Ministers must now refuse to order a discharge either conditional or absolute if satisfied that the patient has a mental disorder, the effect of which is that continuing detention in hospital is necessary to protect the public from serious harm. That is so whether or not the patient is to receive medical treatment for the mental disorder. The second is to introduce a right of appeal against a decision, notification or recommendation of a sheriff in relation to an appeal brought by a restricted patient in terms of Part VI of the Mental Health Scotland Act 1984. Background The province of Alberta referred a reference question to the Alberta Court of Appeal , which was eventually appealed to the Supreme Court. The questions concerned the constitutionality of prohibiting strikes and replacing them with compulsory arbitration. Opinion of the Court McIntyre, argued that the freedom of association is an individual right that protects collective activities which are already protected by individual rights. Thus, activities that are prohibited individually are also forbidden collectively. As such, a trade union cannot strike incident to a collective bargain. Dickson, in dissent, also agreed with the characterization of the freedom, but argued that the right is not associated with particular activities but rather is a freedom of persons to join and act with others in common pursuits .
