  1. QC clause

Unreferenced date June 2007 In insurance law , a QC clause is a clause in an insurance policy usually but not exclusively a professional indemnity insurance policy that provides that an action against the insured is not to be contested unless a Queen s Counsel or QC advises that the defence has a reasonable prospect of success. The principal reason for such clauses is to minimise conflict between the insured and the insurer. The insurer will often wish to settle claims as quickly and cheaply as possible, but the insured may be concerned that paying on a claim implies negligence which will damage their professional reputation, and want to contest the claim regardless. Professional indemnity policies commonly provide that the insurer will pay the legal costs of the defence. It is sometimes suggested that the clause is also designed to protect the public from the unjustified contesting of claims which have no real defence, but this may represent a charitable view of the way insurance companies conduct claims. Conflicts between the insurer and insured can put a solicitor who represents both in an individious position, particularly where the solicitor has received confidential information from one party, and may result in multiplicity of legal representation. In practice however, there is an enormous reluctance to invoke such clauses, partly because of the expense of instructing Queen s Counsel to advise, and partly because of the insurer s need to maintain good relations with the insured. Although still called QC clauses, such clauses often provide that the advice of a junior barrister of a certain seniority may be taken. Some general liability policies contain a converse version the traditional QC clause viz., that the insurer does not need to pay out on a claim against the insured unless a Queen s Counsel advises that there is no reasonable prospect of successfully defending the claim. QC clauses were considered judicially by Patrick Devlin, Baron Devlin Lord Devlin in relation ...   more details

  1. William Taylor QC

William Taylor , Queen s Counsel QC has been a Scottish advocate since 1971 and a Queen s Counsel QC since 1986. Mr Taylor has also been a barrister in England and Wales since 1990 and a QC there since 1998. He has specialised in criminal defence work since the 1980s. The Lockerbie trial William Taylor QC acted as Senior Counsel for Abdelbaset al Megrahi during the Pan Am Flight 103 bombing trial from May 2000 to January 2001, and during the subsequent appeal in January to March 2002. SCCRC Taylor was reappointed Commissioner at the Scottish Criminal Cases Review Commission by Royal Warrant from January 1, 2002 for a further fixed term of four years expiring on December 31, 2005. However, he undertook to resign immediately from the SCCRC if his former client Megrahi were to apply to the Commission for a review of the case. Megrahi applied on September 23, 2003 and Taylor duly resigned on the same day. In a tribute to one of the founding Commissioners, the SCCRC chairman said The Commission greatly values the service which Mr Taylor has given to the Commission over the past four years. I understand and appreciate Mr Taylor s position in deciding to take this course of action. Lord Fraser s remarks As reported in The Sunday Times UK The Sunday Times of 23 October 2005, the former Lord Advocate Lord Fraser of Carmyllie , who initiated the Lockerbie prosecution, said of the main prosecution witness at the Lockerbie trial, Tony Gauci Gauci was not quite the full shilling. I think even his family would say that he was an apple short of a picnic. He was quite a tricky guy. I don t think he was deliberately lying but if you asked him the same question three times he would just get irritated and refuse to answer. Fraser added I wasn t particularly impressed with his Abdelbaset al Megrahi defence their techniques of muddle and confusion can work for a jury but it doesn t work for three judges. Asked for his reaction, William Taylor said Fraser should never have presented Gauci ...   more details

It held that pupil barristers are not included for the purposes of the Act. Facts Rebecca Jane Edmonds was doing a criminal law pupillage with Michael Lawson QC s chambers, 23 Essex Street. She did an English degree, then a law degree, and after her BVC won an unfunded pupillage, consisting of two sets of six months with different barristers at the chambers. Sullivan J held that Miss Edmonds was a worker. The chambers appealed. Judgment Lord Bingham CJ, Pill LJ and Hale LJ held that the pupil was neither an apprentice nor a worker because of an absence of commitment to serve. He emphasised that at the end of the long procedure leading up to pupillage it would be surprising if there were no intention for a contract at all. The argument that there was no consideration, was better, but on balance pupils do provide consideration by agreeing to enter into a close, important and potentially very productive relationship. So there was a contract, but it was not argued that this was a contract of employment or service, but one of apprenticeship. As Blackburn J in The Parish of St Pancras Middlesex v The Parish of Clapham, Surrey 1860 2 El & El 742, 754, I have always thought that by apprentice is meant one who gives his services in order to be taught. All the materials regarding the duties of pupillage imposed no duty to do anything not conducive to her own training and development.
