D. , 1991 1 S.C.R. 742 is a leading decision of the Supreme Court of Canada on assessing guilt based on the credibility of witnesses in a criminal trial. More specifically, W.D. examines sexual assault cases and burdens of proof in evidence law. Background D. W., a 42 year old man, was charged with sexually assaulting a 16 year old girl, T. W., on two occasions while driving her to her boyfriend s house. T.W. was staying at D.W. house at the time. Besides her claim of the event, there was little circumstantial evidence. Her panties had semen stains from a Type A secretor, which included D. W., but also 30 population. The secretor type of the boyfriend was never known. At trial before a judge and jury the defence argued that she was not credible. She was unemployed, illiterate, and a dropout, and had been kicked out of several houses including D. W. s house. The testimony of D.W. was poor, but its uncertain whether it was due to lack of intelligence or deception. At the end of the trial the judge issued its charge to the jury without mention of any issue of credibility. Less than ten minutes later the Crown made a request for a recharge to bring this issue up. Counsel for the Crown requested the recharge in order for the judge to explain ... as to his guilt based on other parts of the accused s evidence. In a similar case, R. v. S. In this case, the Commonwealth imposed a tax on flour millers, but reimbursed the States based on their production of wheat in order to reimburse the flour millers by 90 of their taxes. The problem is that Tasmania , while milling flour, does not produce wheat. The majority held that the taxation was valid since the tax applied equally to all States, and there was no constitutional impediment to granting money discriminately. Per Latham CJ, section 96 is a means by which the Commonwealth, when it thinks proper , can adjust inequalities between States. Thus, because there was no discrimination in taxation, yet grants are not subject to prohibitions based on discrimination, the majority held the laws to be valid. Evatt J, conversely, examined the scheme as a whole, and ruled it invalid. See also Australian constitutional law References George Winterton Winterton, G. et al. In the second trial the judge discovered that one of the jury members had followed the first trial in the media and had consulted a doctor about the evidence. He had shared this information with the other members of the jury. Background Victor Hess and Van Nguyen were both charged in two separate incidents with having sexual intercourse with a female under the age of fourteen contrary to section 146 1 of the Criminal Code of Canada . The provision specifically prohibited a male from having sex with a female under the age of fourteen whether or not he believes that she is fourteen years of age or more . In Hess s trial, the conviction was quashed on the basis that the offence violated section 15 of the Charter . The verdict was overturned at the Court of Appeal and a new trial was ordered. In Nguyen s trial, he was convicted, which was upheld on appeal. The court did not find a violation of section 15, but there was a violation of section 7, which was saved under section 1. The question before the Supreme Court was whether the criminal provision violated sections 7 or 15 of the Charter . Opinion of the Court Justice Wilson, writing for the majority, found a violation of section 7 as the provision did not require a mens rea element in establishing the offence as the accused did not need to know the girl s age.
