Chartier , 1999 1 S.C.R. 242 is a leading Canadian case decided by the Supreme Court of Canada on the legal role of step parent s in a marriage. The Court held that a step parent who is found to be in loco parentis cannot unilaterally withdraw from the family relationship. Gerald Chartier was married to Sharon Chartier who had a child from a previous marriage. Gerald had helped care for the child and took the role a father. The two were separated and Sharon applied for child support. Gerald had argued the he had severed his in loco parentis role and so was not responsible for supporting the child. Justice Bastarache, writing for a unanimous Court, held in favour of Sharon and stated that Gerald could not unilaterally severe ties to the child. To determine if a spouse is in the role of parent, the court must look at a number of factors including whether the child participates in the extended family in the same way as would a biological child whether the person provides financially for the child depending on ability to pay whether the person disciplines the child as a parent whether the person represents to the child, the family, the world, either explicitly or implicitly, that he or she is responsible as a parent to the child the nature or existence of the child s relationship with the absent biological parent.     Louis Chartier 1633 1660 was a surgeon sent to Canada from France in 1653. He was part of an initiative which was to strengthen Montreal. The Soci t Notre Dame de Montr al , who were responsible for founding Fort Ville Marie Ville Marie , had pledged to provide free medical care for the settlers. One of his companions in this endeavour was tienne Bouchard , another surgeon. Chartier died of drowning during a defence of the settlement against an Iroquois attack. It is believed that he also had spent part of one year as a captive of the Iroquois. This early pioneer is important to history because of the role he played in the infancy of the Ville Marie settlement.     Eug ne Chartier 1893 1 November 1963 was a Canadian violinist, violist, conductor, and teacher. Born in Montreal , Chartier studied the violin with Alfred De S ve and Oscar Martel . He played second violin with the Dubois String Quartet from 1915 20, and viola with the Chamberland String Quartet from 1920 25. He also played viola in the CMS Orchestra , the Montreal Festivals , and the Montreal Orchestra . In 1922, he founded the orchestra of the Conservatoire national de musique in Montreal, which became the Montreal Philharmonic Orchestra , giving concerts at the Mount Royal Hotel . He began teaching at the Conseratoire in 1925, and also taught at the colleges of Terrebonne and Berthier , and the convent of Ste milie de Viauville . He was appointed director of the Maisonneuve regimental band in 1932, and became a founding member of the Euterpe Chamber Music Society in 1933. He conducted the CMS Orchestra and some of his performances were broadcast on Canadian Broadcasting Corporation CBC radio.     Paul Joseph Chartier 1921 May 18, 1966 was a Canadian man who died when a bomb he was preparing exploded in a washroom of the Parliament Hill Parliament of Canada . It is believed that he was preparing to bomb the Canadian House of Commons House of Commons . Born in rural Alberta to parents who owned a small hotel, Chartier became a trucker at age 20. However, in 1960 he ran into financial trouble and was forced to declare bankruptcy and sell his truck. He was also investigated for fraud and his marriage failed. Moving to Toronto, he settled in a rooming house on Major Street. After his death, police found a number of writings and letters earlier sent to newspapers were uncovered. He stated that because of government actions, no one could afford to live and that politicians were rich and greedy. He attacked politicians and homosexuals in his writings. He wrote that his plan was to exterminate as many members as possible, and that he was prepared to die in the process. He declared his desire to become Prime Minister of Canada, and stated that he would appoint Toronto alderman June Marks as his Vice President. When police raided his apartment, they found several other sticks of dynamite. Before the attack, Chartier had purchased ten sticks of dynamite in Newmarket, Ontario . After assembling a bomb, he travelled to Ottawa and entered the gallery of the House of Commons. At the time, visitors to Parliament were not searched.
