Facts Ms Johnston was made redundant when her fixed term contract was not renewed. Women were prohibited from carrying firearms. But many police duties involved carrying firearms. The Royal Ulster Constabulary argued the ban was justified because 1 they may be more frequent assassination targets 2 their guns could end in enemy hands 3 the public would object to it 4 it would hinder their jobs in social, family and children related work. Judgment The European Court of Justice held it was up to the Industrial Tribunal to determine whether art 2 2 now art 14 applied having regard to the specific duties which Ms Johnston is required to carry out Referring to article 2 2 of the Directive, it should be observed that that provision, being a derogation from an individual right laid down in the directive must be interpreted strictly. However, looking at the context it cannot be excluded that there would be more risks if policewomen carried firearms. So that may be a determining factor, and if so the member state can place a restriction, which need periodic review under art 9 2 . There must also be proportionality so derogations remain within the limits of what is appropriate and necessary for achieving the aim in view ... 1. Royal Irish Artillery

unreferenced date August 2008 The Royal Irish Artillery was an Irish regiment of the British army in the 18th century. It was formed in 1755 as The Artillery Company of Ireland . The name was changed in 1760 to The Royal Regiment of Irish Artillery They were recruited all over Ireland and were trained in Dublin Castle and then in Woolwich . Citation needed date November 2010 Parts of the Regiment were sent to Canada in 1777 with Major General John Burgoyne , taking part in the American War of Independence . In addition, some Royal Irish Artillery gunners were shipped directly to New York under Brigadier General James Pattison. The General s papers were reprinted by the New York State Historical Society in 1876, a detailed source of information on this subject. Pattison, being head of the British Artillery in North America during part of the American Rebellion, had much to say about his Irish. They were his diminutive warriors , bare breeched , were lower than serpents . He said that they were ... uniforms, Pattison wrote, give them to the Irish . Yet in spite of all the derogatory remarks, the Royal Irish Artillery was awarded white leather stocks as a mark of their good gunnery. In 1801, following the Act of Union and the formation of the United Kingdom, the Royal Irish Artillery was absorbed as an integral part of the Royal Artillery and therefore ceased to exist. Facts Ms Shamoon was a chief inspector. She did appraisals of the constables in the Urban Traffic Branch. Her appraisal duties were removed from her after complaints were made about the way she did them. She was dismissed and made a claim under the Sex Discrimination Northern Ireland Order 1976, which is the same as the SDA 1975 , and now found in the Equality Act 2010 . The Employment Tribunal held that there was sex discrimination. It said that the appropriate comparators were two male chief inspectors who were in the same branch and had the same duties, in which they continued, but who had not had complaints against them. The Northern Ireland Court of Appeal held that her claim failed because the two comparators she pointed to who had done similar appraisals had had no complaints made against them. Judgment The House of Lords held that the comparators were inappropriate because there had been no complaints about them. Lord Hope agreed that the comparators were inappropriate. He noted that choosing which characteristics are relevant for the purposes of comparison should not defeat the purpose of the legislation, which is to eliminate discrimination against women on the ground of their sex in all areas with which it deals. 1. Royal Irish Rifle Volunteers

The Royal Irish Rifle Volunteers was a Volunteer Corps established in Dublin , Ireland in 1860, in response to the Volunteer Force movement in the United Kingdom. The establishment of the corps was largely instigated by Colonel Fitzstephen French , of Frenchpark, County Roscommon , an Member of Parliament MP for that county. Proponents of the force saw it as a way of uniting Irishmen of differing religious and political backgrounds in the common defence of their country. French attempted, but failed, to introduce a bill, the Volunteer Corps Ireland Bill, which would legitimise the setting up of a Volunteer Corps in the country. The following year the organisation was renamed the Loyal Association for Irish Rifle Volunteers. Background On 12 May 1859 the Secretary of State for War , Jonathan Peel had issued a circular letter to Lord lieutenant lieutenants of counties in England, Wales and Scotland, authorising the formation of volunteer rifle corps VRC, a.k.a. corps of rifle volunteers and rifle volunteer corps , and of artillery corps in defended coastal towns. ref War Office Circular, 12 May 1859, published in The Times , 13 May. ref Volunteer corps were to be raised under the provisions of the Volunteer Act 1804 44 Geo.3 c.54 ref cite book last Fortescue first John authorlink John Fortescue military historian title The county lieutenancies and the army, 1803 1814 url http www.archive.org stream countylieutenanc00fortiala page 134 mode 2up year 1909 publisher Macmillan Publishers MacMillan and Co. location London page 135 ref However, despite the intercession of some Irish ..., the London Irish Rifles Irish Rifle Volunteer Corps had been set up in London in 1859.
