Ct. 1948 , aff d, 87 N.Y.S.2d 430 New York Supreme Court, Appellate Division N.Y. App. Div. 1949 , was a copyright lawsuit. In The Iron Curtain film The Iron Curtain , a 1948 motion picture depicting Soviet Union Soviet espionage in Canada , 20th CenturyFoxTwentiethCenturyFox used compositions by composers, who were citizens and residents of the Soviet Union as background music, and on the film credited these composers with the compositions. The name of one of the composers, Dmitri Shostakovich was also used in the picture when one of the characters therein incidentally referred to him in an appreciative manner. All of the music used was in the public domain and had no copyright protection , therefore the court refused to Wiktionary enjoin enjoin the use of the names and the music. Furthermore, the use of the composers names in conjunction with the compositions is not subject to restraint under the New York State civil rights law 51 . In the absence of copyright, others may use the names of the authors in copyrighting, publishing or compiling their works. Assuming that the publication of defamatory matter may be enjoined, there was no showing that the composers have been slander and libel slandered or libeled . There is furthermore no indication in the motion picture that the composers participated in or gave their approval or indorsement to the picture nor is their approval of it necessarily implied therein. No such implication exists, necessarily or otherwise, where the work of the composer is in the public domain and may be freely published, copied or compiled by others. Unreferenced date December 2009 Orphan date December 2009 Francis, Day & Hunter Ltd. v. TwentiethCenturyFox Corp. 1939 4 D.L.R. 353 is a leading Judicial Committee of the Privy Council opinion on copyright law . The Council held that copyright cannot subsist in non original work or in the title of a work alone unless it is original and distinctive. Francis, Day and Hunter had released a song titled The man who broke the bank at Monte Carlo . Years later, 20th CenturyFox put out a movie by the same title, but had no other connections to the song. Francis sued for copyright infringement. Lord Wright held that a name alone cannot possess copyright unless it is sufficiently original and distinctive. To break the bank is a hackneyed expression, and Monte Carlo is or was the most obvious place at which that achievement or accident might take place. Societe Fox Europe and Societe Fox Americaine TwentiethCentury is a French case had the same facts as the New York case Shostakovichv. TwentiethCenturyFox , wherein four Russia n composer s sued TwentiethCenturyFoxFox to prevent the use of their public domain compositions in an anti communism Communist film . The New York court presciently summed up the future holding of the French court, where it predicted that Moral rights copyright law droit moral could prevent the use of a composition or work, in the public domain. The film was ordered seized. Russian music for many decades was in the public domain in the United States and western Europe, as a form of Revenge payback for the Soviet Union not recognizing western copyright s. Normally authors will be long dead before their works come into the public domain, however depending on the country there is authority that authors may dedicate their works to the public domain voluntarily. The Shostakovich and Le Chant du Monde problem, therefore is still with us. The problem is that voluntarily dedicated works may not truly be freely available for modification or even aggregation the music in Le Chant du Monde was merely a motion picture soundtrack until the author is dead, even though the works quite clearly are in the public domain. The TwentiethCentury Society is a UK British Charitable organization charity which campaigns for the Historic preservation preservation of architectural heritage from 1914 onwards. The society s interests extend to buildings or artefacts, whether important or humble, rare or commonplace, that characterise TwentiethCentury Britain. The Sociey was formed as The Thirties Society in 1979, the year in which the Thirties exhibition was shown at the Hayward Gallery . The idea came from The Victorian Society which aims to protect pre 1914 Victorian and Edwardian buildings. Though several modern buildings had been listed on the recommendation of Nikolaus Pevsner in 1970, it was felt by John Harris curator John Harris and Sir Simon Jenkins that much more needed to be done. Bevis Hillier was the first president, Clive Aslet the first honorary secretary. In 1992, it changed its name to The TwentiethCentury Society as it was felt that Thirties Society was a poor description as the society aimed to protect buildings from other periods as well. Merge The 20th Century date May 2012 The TwentiethCentury is a half hour Documentary film documentary television series broadcast over CBS TV from 1957 until 1966. ref http www.imdb.com title tt0050072 IMDB entry ref It was hosted and narrated by Walter Cronkite and telecast Sunday evenings originally at 6 30 p.m. Eastern Time, shifting to 6 p.m. in the fall of 1961 . Its theme music was written by American composer George Antheil . The series covered significant events of the era, including World War II and consisted largely of newsreel footage. Unlike today s World War II documentaries, the program contained none of what we now know as talking heads footage. However, some episodes focused on contemporary subjects, such as The Violent World of Sam Huff , a behind the scenes profile of the New York Giants American football football player which originally aired on October 30, 1960. The series was sponsored by Prudential Insurance , with the opening and closing credits for the series superimposed over a still photo of the Rock of Gibraltar , Prudential s symbol. The series won two Emmy Award s, and was succeeded in January 1967 by The 21st Century , a slightly different documentary series focusing on the future, which lasted until January 1970. This was a long running documentary series telecast weekly by a major commercial television network, at an hour close to prime time . Such a practice would most likely be frowned on by today s commercial TV executives, who would probably relegate the show either to Public Broadcasting Service PBS or to cable television .
