In medieval finance, a gage could come in two forms a mort gage or a vif gage . When the owner of property needed liquidity liquid resources, they could exchange their property, as a surety , for cash. Since the gage was typically a piece of property which generated revenue i.e. a farm which produced crops, a mill which processed food, a pasture that provided milk or wool, etc. , the creditor received the benefits of the land. Under the terms of a vifgage , these benefits reduced the amount the borrower owed, while under a mortgage they did not. This meant that if the property was prosperous enough, or the loan small enough, a property in vifgage could pay off the debt itself. On the other hand, with a mortgage , the benefits of the property constituted interest on the loan, which made it a form of usury . This meant that mortgages were seen as immoral illegal among Usury Scholastic theology Catholic theologians . ref Gage by Constance Berman, p. 380, in Medieval France an encyclopedia , by William W. A contractum trinius was a set of contracts devised by Europe an bankers and merchants in the Middle Ages as a method of circumventing canon law Roman Catholic Church canon law edicts prohibiting usury . At the time, most Christian nations heavily incorporated scripture into their laws, and as such it was illegal for any person to charge interest on a loan of money. To get around this, a set of three separate contracts were presented to someone seeking a loan an investment , a sale of profit and an insurance contract. Each of these contracts were permissible under Catholicism Church law, but together replicated the effect of an interest bearing loan. The way this procedure worked was as follows The lender would invest a sum equal to the amount of financing required by the borrower for one year. The lender would then purchase insurance for the investment from the borrower, and finally sell to the borrower the right to any profit made over a pre arranged percentage of the investment. This system replicated the effects of a loan with any interest rate agreed between the two, yet provided protection to the lender against Default finance default , while the borrower remained under the protection of the law when it came to collection of the money by threats or force loan shark ing . The Church proved utterly unable to legislate against the contractum trinius, and the idea quickly spread to merchants and bankers across Christendom . It was accepted by writers such as Gabriel Biel it helped in part to improve public perception of the practice of usury by moneylenders, and ultimately the doctrine was rewritten by the School of Salamanca , and the ban on interest bearing loans overturned in many Protestant countries, starting with England by Henry VIII of England Henry VIII . Some Muslims are of the view that the present practice of Islamic banking relies on devices similar to the contractum trinius as a means of working around a ban of riba usury in religious scripture. orphan date January 2010 A discretionary deposit is the term given to a device by Middle Ages medieval Europe an banker s as a method of circumventing Catholic Church Catholic canon law edicts prohibiting the sin of usury . At the time, most Christian nations heavily incorporated Bible Biblical scripture into their laws, and as such it was illegal for any person to charge interest on a loan of money. The name comes from the workings of the device a rich person would Deposit account deposit a large sum with a bank. His name would be kept a secret at the banker s discretion , as a discretionary deposit was seen as an obvious dodge around the charging of usury, and it would have embarrassed the Pope , cardinal Catholicism cardinal s, and various nobles and merchants who made use of this device. Every year, in gratitude for the personage s deposit, the banker would make the account a gift , the exact amount of which would be at the banker s discretion. Of course, the gifts would work out to whatever the prevailing rate was, 8 12 , perhaps. Should a banker s gifts be too little, depositors would eventually take their money to another bank whose gifts were more commensurate with the going rate. Discretionary deposit accounts were not demand deposit accounts, and so notification of withdrawals often had to be given in advance sometimes as much as a year ref pg 54 of De Roover 1948 ref . Orphan date February 2009 Francis Adorno 1521 January 13, 1586 was a celebrated Italy Italian preacher. He was a member of the family of the last Doge of Genoa , and was born three years after the name of the Adorno family Adorni was suppressed, and the office of Doge abolished. This measure was taken to put an end to the strife of 165 years between that family and the Fregosi , whose name also was changed. This political revolution was effected by Andrea Doria , the famous Genoese admiral. Francis entered the Society of Jesus in Portugal , whither he had been sent to pursue his studies. He was recalled to Rome , where he taught theology , and gained at the same time the reputation of being one of the greatest orators in Italy. He was the first rector of the College of Milan , and was subsequently charged with the administration of several houses of the Order. He was the friend, adviser, and confessor of St. Charles Borromeo . He died at Genoa . Besides two volumes De Disciplina Ecclesiastic , which he wrote at the request of St. Charles, there remain his sermons, some Latin verse, counsels to Herbert Foglieta De Ratione Illustrand Ligurum Histori , and, in the Biblioteca Ambrosiana , a treatise on Usury . Tardi Beg was a military commander in the 16th century in Mughal India . He served under the Mughal Emperor s Humayun and Akbar . Beg was part of Humayun s forces when they retreated from India after the siege by Sher Shah Suri Sher Shah . He remained with his leader throughout his exile in Persia . It is reported that he was disliked by both the troops and generals and was eventually killed for cowardice by Bairam Khan . Beg is said to have refused to give up his horse for the heavily pregnant Hamida, wife of Humayun, when she was eight months pregnant with her son Akbar . He is also said to have charged Humayun 20 Usury interest on a loan. Beg was further accused of deserting the city of Agra as soon as Hemu s forces approached. The truth of these allegations is difficult to gauge as most were written after his death and following the great successes of Bairam Khan , his executor.
