Refimprove date April 2008 The New York Police and Fire Widows and Children s Benefit Fund was created in 1985 by former New York Mets player Rusty Staub and Paddy Burns, who was then the Vice President of the New York Patrolmen s Benevolent Association. Since its inception, the foundation has distributed over 114 million to the families of New York City police and fire personnel who have been killed in the line of duty. Initially created to assist families of NYPD and NYFD Officers and Firefighters, the fund now includes the families of Emergency Medical Services and Port Authority Officers as well. It was an unincorporated association registered under the Friendly Societies Act 1896. It had no rules for how assets should be distributed if it was wound up. It was disputed whether surplus assets should go to the Crown as bona vacantia , or be distributed among the members equally on a per capita, or another basis. Judgment Walton J held that the present members of the association shared in the surplus property equally.
